Service Agreement Terms

These Terms and Conditions govern the relationship between Sgt. Paul Heat & Air ("Sgt. Paul," "we," "us," or "our") and our customers ("you," "your") when using our HVAC services or visiting our website.

Acceptance of Terms

By using our HVAC services or website, you agree to these Terms and Conditions. If you do not agree to all of these terms, you should not use our services or website.

Service Appointments

  • Appointment times are approximate and may vary based on prior service calls and travel time in our service area.
  • A responsible adult (18 years or older) must be present during service visits.
  • We require safe access to all areas where HVAC work will be performed, including attics, basements, and mechanical rooms.
  • Rescheduling with less than 24 hours notice may incur a service fee.
  • Free estimates are valid for 30 days unless otherwise specified in writing.
  • Priority service calls may have different scheduling and pricing terms.

Pricing and Payment

  • Pricing is based on standard HVAC service calls during regular business hours (Monday-Friday, 8AM-5PM).
  • Additional charges apply for priority service, after-hours calls, weekends, and holiday service.
  • Payment is due upon completion of service unless prior financing arrangements have been approved.
  • We accept cash, checks, and major credit cards (Visa, MasterCard, Discover, American Express).
  • Financing options are available through our partners subject to credit approval.
  • Returned checks will incur a $35 service fee plus any applicable bank charges.
  • Past due accounts may be subject to interest charges and collection fees.

Warranties and Guarantees

  • Labor performed by Sgt. Paul Heat & Air is warranted for 90 days from the date of service completion.
  • Parts are warranted according to manufacturer specifications and warranty terms.
  • New HVAC equipment installations carry their respective manufacturer warranties.
  • Mobile and modular home HVAC installations include specialized warranties appropriate for manufactured housing.
  • Warranty coverage is void if equipment is serviced, modified, or repaired by unauthorized persons.
  • Warranties do not cover damage from acts of nature, power surges, flooding, or customer negligence.
  • Regular maintenance per manufacturer guidelines is required to maintain warranty coverage.
  • Club Membership benefits and terms are governed by separate membership agreements.

Customer Responsibilities

  • Provide accurate and complete information about HVAC service issues and system history.
  • Ensure pets are properly secured during service visits for technician and animal safety.
  • Provide clear, safe access to HVAC equipment, electrical panels, and work areas.
  • Notify us of any potential hazards, electrical issues, or special conditions at your property.
  • Maintain HVAC equipment according to manufacturer recommendations and our service guidelines.
  • For mobile homes: Ensure proper skirting access and structural stability around equipment areas.
  • Disclose any previous unauthorized repairs or modifications to HVAC systems.

Limitations of Liability

Sgt. Paul Heat & Air is not responsible for:

  • Damage to customer property concealed behind walls, under floors, in ceilings, or within ductwork systems.
  • Pre-existing building code violations, electrical issues, or hazardous conditions.
  • Consequential damages resulting from HVAC equipment failure or system downtime.
  • Delays caused by weather, unavailability of parts, manufacturer issues, or circumstances beyond our control.
  • Damage caused by acts of nature, power surges, flooding, or customer/third-party negligence.
  • Issues related to inadequate electrical service, structural problems, or building deficiencies.
  • Mobile home structural issues, skirting problems, or tie-down system concerns.
  • Our total liability shall not exceed the amount paid for the specific service in question.

Cancellation Policy

  • Standard service appointments may be canceled with 24 hours advance notice without penalty.
  • Major HVAC installations require 48 hours notice for cancellation or rescheduling.
  • Priority service calls cannot be canceled once our technician is dispatched.
  • Cancellations with insufficient notice may result in a service fee of up to $75.
  • Deposits for custom ordered equipment or special-order parts are non-refundable once orders are placed.
  • Club Membership cancellations require 30 days written notice.

Specialized Services

  • Mobile & Modular Home HVAC: We provide specialized services for manufactured housing with appropriate equipment and HUD-compliant installations.
  • Priority Service: Available for urgent HVAC failures with priority response for Club Members.
  • Club Membership: Maintenance plans governed by separate membership terms and conditions.
  • Financing Services: Provided through third-party partners with separate terms and credit requirements.

Website Use and Privacy

  • Content on our website is for informational purposes only and should not replace professional consultation.
  • We reserve the right to modify website content, pricing, and service information without prior notice.
  • Users may not copy, reproduce, or distribute our content without written permission.
  • Our website may contain links to third-party websites that we do not control or endorse.
  • We respect your privacy and handle personal information according to our Privacy Policy.
  • Contact form submissions constitute consent to be contacted regarding HVAC services.

We primarily serve Sweetwater, TN and surrounding communities including:

  • Other areas within reasonable travel distance may be served with additional travel charges.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes indicates your acceptance of the revised terms. For significant changes, we may notify customers via email or other appropriate means.

Governing Law and Disputes

These Terms and Conditions are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Monroe County, Tennessee, or through binding arbitration if mutually agreed upon. Both parties agree to attempt good-faith resolution of disputes before pursuing legal action.
